Privacy Statement

This privacy statement sets out the personal data processing activities conducted by NMT Australia Pty Ltd, an Australian company with limited liability, with its office address at 16/524 Abernethy Road, Kewdale WA 6105 Australia, registered in Australia under business number: 12 112 932 886, and its group companies, subsidiaries, and related corporations (“NMT”).

Legislation

Personal data is processed by NMT in accordance with this privacy statement and the General Data Protection Regulation (Regulation EU 2016/679) (“GDPR”), relevant GDPR implementation Acts, the Australian Privacy Principles under the Privacy Act 1988 (Cth), and the provisions of other applicable laws, regulations, and rules.

Type of Personal Data

The personal data NMT processes may include:

  • Names and (professional) email addresses of contact persons of NMT’s business relations, such as clients and suppliers. This may include name, business email address, business telephone number, and company address. NMT processes this data for the purpose of providing NMT’s services;
  • Personal data of NMT’s clients or their officers or (indirect) shareholders to the extent required by applicable law and regulations. This may include name, date of birth, and copy of the passport;
  • Personal data in connection with job applications. If a candidate is not hired, NMT will delete the personal data after a period of 1 month, unless NMT has the candidate’s consent to retain the personal data for future job opportunities;
  • Data necessary for processing invoices;
  • Metrics of any visits to NMT’s website.


Use of Personal Data

Personal data is used by NMT on the following basis:

  • To conclude and perform a contract;
  • To comply with regulatory and policy requirements;
  • For a legitimate interest (e.g., managing and administering the relationship with clients and/or suppliers);
  • With the consent of the person whose personal data is processed.


When Personal Data is Obtained

NMT obtains personal data in the following situations:

  • When a person provides NMT with his/her personal data, or when a person interacts with NMT directly (by email, telephone, or letter);
  • When a client enters into an agreement with NMT;
  • When NMT monitors its technology tools and services, including visits to NMT’s website and the emails sent to and from NMT’s offices;
  • When NMT collects personal data from other sources, such as the Trade Register, commercial databases, or by using public sources;
  • When personal data is submitted to NMT in connection with a job application.


Purposes for Processing Personal Data

NMT processes personal data for the following purposes:

  • To communicate about, execute, and/or provide NMT’s services, including supporting processes and systems relating thereto;
  • To manage and administer NMT’s relationship with business relations, such as clients and suppliers;
  • To comply with regulatory and policy requirements;
  • To identify services persons may be interested in;
  • To improve NMT’s website by generating statistics regarding the use of the website;
  • To monitor and/or analyse NMT’s business processes and systems;
  • To handle job applications or subscriptions to any of NMT’s recruitment services or events;
  • To establish, exercise, or defend legal claims and/or proceedings against NMT and/or its staff;
  • Business development activities;
  • To process and respond to requests, inquiries, or complaints from persons whose personal data are collected and/or processed;


Retention Period

NMT retains personal data no longer than necessary for the processing purposes stated herein.

Other Offices and Third Parties

In connection with the provision of NMT’s services, NMT may need to share personal data with its other offices worldwide. NMT also shares personal data with third parties engaged by NMT in connection with the provision of NMT’s services, such as suppliers, to the extent required for the provision of the services. NMT furthermore shares personal data with third-party service providers, such as hosting and cloud service providers and administrative or financial service providers. Only personal data required for the provision of the services is shared with these service providers. Any transfer of personal data outside the EU/EEA or Australia is made in line with applicable data protection laws.

Third parties with whom personal data is shared by NMT are themselves responsible for such personal data, including compliance with applicable laws on data protection. NMT is not responsible or liable for the processing of personal data by such third parties. Employees have access to personal data to the extent required for the performance of their tasks. All employees of NMT are subject to a duty of confidentiality.

Rights

Each individual whose personal data is collected and processed by NMT has the following rights:

  • Right to access personal data of the respective individual;
  • Right to rectification or correction of his/her personal data;
  • Right to erasure of his/her personal data;
  • Right to object or request restriction of processing of his/her personal data;
  • Right to data portability;
  • Right to object to profiling;
  • Right to lodge a complaint with a supervisory authority;
  • Right to withdraw his/her consent for the future to the extent that the processing of the personal data takes place on the basis of his/her consent.


To the extent that NMT’s data processing is based on an individual’s consent, this person at all times has the right to withdraw his/her consent. Withdrawal does not affect the lawfulness of the processing that was based on any given consent before it was withdrawn. If an individual wishes to make use of the aforementioned rights, please contact NMT by letter or email, using the contact details shown below. NMT will take a decision on your request within four weeks. Furthermore, complaints may be submitted to the relevant supervisory authority. The competent supervisory authority in The Netherlands is the Dutch Data Protection Authority, and in Australia, it is the Office of the Australian Information Commissioner (OAIC).
